Terms and conditions of sale Apoticaria

Services impacted by the current situation: The delivery times specified below are provided for information purposes only. Current circumstances are disrupting our operations and deliveries may be delayed.

Article 1 - Scope of application

The present General Terms and Conditions of Sale (the " GTCS ") govern all relations between :

  • The company Apoticaria, a limited liability company with a capital of 102300 Euros, having its registered office at Lieu dit Mateuil, 32190 Belmont, registered with the RCS of Auch under the number 493 713 127, whose intra-community VAT number is FR27493713127, and reachable by phone at +33 (0)5 62 66 50 76 during business hours and by e-mail at the following address contact@apoticaria.com (the " Seller " or "Apoticaria" ), and
  • The natural person of age or legal entity, who orders product(s) through the Apoticaria website accessible from one of the following URLs: apoticaria.com and/or www.pro.apoticaria.com, (hereinafter the " Customer " or " Buyer").

Article 2 - Purpose

The purpose of the GTC is to describe the terms and conditions of distance selling of goods between the Seller and the Customer. They express the entirety of the obligations and rights of the Parties.

Apoticaria reserves the right to modify these Terms and Conditions at any time. However, the Terms and Conditions applicable to the Order are those accepted by the Buyer at the time of placing the Order or Pre-Order. It is the Customer's responsibility to read the Terms and Conditions of Sale for each Order or Pre-Order placed. The GTCS can be viewed before and at the time the Customer is asked to validate the Order.

Article 3 - Availability and Acceptance of the General Sales Conditions

These general terms and conditions of sale apply without restriction or reservation to all sales of products offered by Apoticaria on the website of its online stores www.apoticaria.com and www.pro.apoticaria.com, as well as to mail order sales of products offered by Apoticaria in its paper catalog (hereinafter the " Site ").

They can be accessed at any time by going to the "Terms and Conditions" section of the Site and the Buyer. They are systematically made available to the Customer to enable him to place his Order with Apoticaria, the Customer also has access to them at the time of validation of his Order.

The fact that the Buyer orders or pre-orders a product offered for sale on the Site implies full and complete acceptance of these General Terms and Conditions of Sale, which the Buyer acknowledges having read prior to his or her Order or Pre-Order.

No general or specific condition appearing in the documents sent or given by the Customer may be integrated into the present terms and conditions, if these documents are incompatible with the present terms and conditions.

Article 4 - Entry into force - Duration

These terms and conditions apply throughout the entire period that the products offered by Apoticaria on the Site are online until the end of the warranty periods.

Article 5 - Order

5.1 - Product characteristics

Each product offered on the Site is the subject of a description that presents its essential characteristics. The photographs or graphic representations used to illustrate the products, standard or personalized, are not contractual.

5.2 - Prices

The selling prices of the products online on the Site are indicated in Euros, and are those in effect at the time the Buyer places the Order. They can be modified by Apoticaria at any time. They do not include shipping costs, which are charged extra. The delivery costs will be indicated before the Order is validated by the Buyer.

The various shipping methods are set forth below in the T&Cs and are recalled on the Site; they may be modified at any time by Apoticaria. The prices include the VAT applicable on the day of the Order. Any change in the applicable VAT rate will automatically be reflected in the price of the products sold by Apoticaria on the Site.

The payment of the totality of the price must be realized at the time of the Order. At no time, the sums paid can be considered as deposits or down payments.

5.3 - Availability of products

  1. Product availability

The offers presented by Apoticaria are valid as long as they are announced on the Site and within the limits of available stocks.

In the event that the Product ordered or pre-ordered is unavailable, in particular due to Apoticaria's suppliers, the Customer will be informed by email as soon as possible and will have the option of cancelling the Order or Pre-Order. The Customer will then have the option of requesting either a refund of the sums paid within a maximum of 14 days from the cancellation of the Order or Pre-order, or an exchange of the product in the form of a credit note.

In case of partial availability of items, Apoticaria may split the Order. Thus, the available items may be sent first, the balance of the Order will be sent when all other items are available.

Apoticaria reserves the right to change the products offered on the Site at any time and without notice.

  1. Specific provisions for the Pre-order

A Pre-Order refers to items that are marked as such on their product description page on the Site and that can be purchased on the Site before they are available in stock at Apoticaria (the "Pre-Order " or " Pre-Ordered Product " or " Pre-Order Product "). The list of Pre-orderable Products is subject to change at any time by Apoticaria.

In the event of unavailability of the pre-ordered Product, in particular due to Apoticaria's suppliers, the Customer will be informed by email as soon as possible.

The Pre-Order may be cancelled unilaterally until it is shipped by Apoticaria or the Customer. The Customer will then have the choice of requesting either a refund of the amounts paid within a maximum of 14 days from the cancellation of the Pre-Order, or the exchange of the product in the form of a credit note.

In the event that Customer simultaneously orders both in-stock and pre-ordered Products on the Site, shipment of the in-stock Products may be delayed until the Pre-ordered Product is ready to be shipped. To ensure faster delivery of in-stock items, it is recommended that Buyer place two separate orders: one for the Pre-ordered Products and one for the in-stock items on the Site.

Apoticaria reserves the right at any time to modify or temporarily discontinue all or part of the Pre-Order service for technical or other reasons.

5.4 - Placing the Order

  1. Product Selection

At any time, you can add Products to your selection by clicking on "Add to Cart", and choose to finish shopping or continue browsing. You can view your selection by clicking on "Shopping Cart" in the top right-hand menu.

  1. Identification

After selecting the Product(s), click on "Proceed to checkout" to start the ordering process.

The Customer may place an Order on the Web site after registering for an account on the Web site (the "Customer Account"). Any Customer wishing to place an Order on the Web site will be asked to identify himself/herself.

At the time of the first connection, the Customer shall enter his/her login and password. Each time the Customer connects to the Web site for a new Order, he/she shall enter his/her login and password in order to access the products and his/her Customer Account. If the Customer loses or forgets his or her password, he or she can automatically receive his or her password by e-mail by clicking on the "Forgot your password?

Customer may deactivate its Customer Account at any time by sending an email to Apoticaria's customer service department at contact@apoticaria.com or by clicking on the "Contact Form" link on the Site. After deactivating its Customer Account, Customer is free to create a new Customer Account at any time.

  1. Validation of the Order
a) Validation of information and delivery method

    You will have to fill in the delivery information necessary for the proper shipment of your Order: country of shipment, title, first name, last name, telephone number, delivery address, and then you will be invited to validate your delivery method.

      b) Validation of the payment method and verification of the Order

        You will then be prompted to select a payment method and enter the relevant information. You will have the option of using your shipping address as your billing address or entering a different one. At the end of the ordering process described above, click on the "Check Order" button. 

        Before confirming and paying for your Order, you have the opportunity to review the details of your proposed Order and correct any errors. You must check the accuracy of your selection before confirming your Order and validating your payment. By clicking on the "Confirm your payment" button, you confirm your Order and accept all of our General Terms and Conditions of Sale and our Refund Policy, the prices, volumes, characteristics, quantities and delivery terms of the products offered for sale and ordered, as well as the fact that your Order implies an obligation to pay on your part,

        The distance selling contract is concluded from the moment the Buyer confirms his or her Order by clicking on the "Confirm payment" icon (hereinafter and above the "Order").

        Once this step is validated, the Buyer will not be able to cancel his Order. The sale will be final (subject to the exercise by the Buyer of his right of withdrawal under the conditions provided for in Article 10 of these General Conditions of Sale).

          5.5 - Order Confirmation

            The Order and the contractual information will be confirmed by e-mail. This confirmation will be made immediately after the Order or at the latest at the time of delivery. We advise you to keep this acknowledgement of receipt on a paper or electronic medium.

            5.6 - Proof of the Order

            The computerized registers, kept in the computer systems of Apoticaria under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is done on a reliable and durable medium that can be produced as proof.

            Article 6 - Terms of payment

            The Buyer has the option of paying for the Order on the Site, or in case of difficulties, by telephone to Apoticaria's customer service department at +33 (0)5 62 66 50 76, under the conditions below.

            In order to pay for the Order, the Customer has the choice of all the payment methods made available by Apoticaria, namely: payment by credit card, bank transfer, PayPal, or check. The Customer can also pay in Bitcoin or "Bitcoin Cash" with the Bitpay payment solution that converts Bitcoins into Euros.

            The Customer guarantees Apoticaria that he/she has the necessary authorizations to use the method of payment chosen by him/her when placing the Order or Pre-order. Apoticaria reserves the right to suspend all Order processing and deliveries in the event of a refusal to authorize payment by credit card by officially accredited organizations or in the event of non-payment. In particular, Apoticaria reserves the right to refuse to make a delivery or to honor an Order from a Customer who has not paid in full or who has partially paid a previous Order or with whom a payment dispute is being administered.

            Article 7 - Terms of delivery

            7.1 - Terms of delivery

            • Home delivery

            The products ordered are delivered to the address indicated by the Customer as the delivery address on the order form concerned, in metropolitan France, DOM-TOM or internationally.

            • Delivery in relay

            The parcel containing the ordered and paid products is dropped off at the relay selected by the Buyer among those proposed by the Site at the time of his Order.

            The Buyer of the Order receives a notification from the carrier allowing him/her to withdraw the package at the relay during the time indicated by the carrier. Pick-up at the relay is only possible upon presentation of the carrier's notification and the Buyer's ID. After this period, the package is returned to the sender. In this case, the Buyer will be reimbursed the amount of the Order, minus shipping costs, by any means Apoticaria chooses.

            For the delivery of the products ordered by the Customer, Apoticaria mainly uses the Chronopost and Colissimo services of the Post Office, UPS or DHL.

            To reduce to the maximum the transport costs, all the products of small or average size are sent by the service of the Post office Colissimo Suivi. In addition to being economical, this service delivers in 48 hours throughout France and offers the customer the possibility of recovering the ordered products in a post office close to the delivery address (that he informed at the time of purchase) in case of absence at the time of the initial presentation of the factor. Concretely, if you are absent the day of the delivery, your factor will leave you a notice of passage in your mailbox, which will allow you to withdraw your parcel to your post office during the opening hours, during a 15 days deadline. Colissimo Suivi is a very reliable service set up by La Poste.

            For the delivery of products ordered by the Customer for countries other than France, the delivery terms differ from one country to another. In general, upon delivery, a delivery note or acknowledgement of receipt shall be signed by the Buyer or the recipient of the Order. This is proof of delivery by Apoticaria and receipt by Buyer or Order recipient of the ordered products.

            7.2 - Delivery times

            Apoticaria will use its best efforts to ensure that the order is prepared and delivered to the carrier within an average of one (1) to seven (7) business days from the day after the Buyer validates its Order.

            Article 8 - Complaint procedures

            8.1 Procedure to follow in case of a claim for loss of the package or delay in delivery

            The services Colissimo Suivi, Chronopost set up by the Post office just like the services of UPS and DHL are very reliable services. However, it is possible, as in any expedition, that there may be a delay in delivery or that the product gets lost.

            In the event of a delay in delivery from the time of shipment of the Order, more than 6 days for Chronopost and 11 days for Colissimo Suivi, more than 24 hours for UPS, after the delivery date provided by the carrier, the Buyer shall inform Apoticaria's customer service by telephone at: +33 (0)5 62 66 50 76 or by e-mail at the following address: contact@apoticaria.com.

            Apoticaria will forward the information to the Post Office to initiate an investigation. This investigation can last up to 21 days from the time it is opened. If during this time the product is found, it will be sent back to the Buyer's home immediately (in most cases). If on the other hand the product is not found at the end of the 21 days of investigation, the Post office considers the parcel as lost. Under these conditions, after confirmation of the loss of the package by the carrier, Apoticaria will then send the Buyer a replacement product at its expense. If the lost product(s) were no longer available at that time, Apoticaria will reimburse the Buyer for the amount of the products affected by the carrier's loss.

            Apoticaria is not responsible for extended delivery times due to the carrier, whether or not due to force majeure, including loss of products or strikes.

            Any claim for loss of the package or delay in delivery made more than thirty (30) calendar days after the date of validation of the Order shall not be taken into account.

            8.2 Procedure to follow in case of a claim for damaged package, missing product, broken product, damage, anomaly

            The Customer or the recipient of the Order is responsible for checking the condition of the packaging of the goods upon delivery. Any anomaly concerning the delivery (missing product compared to the delivery slip, damaged package, broken product, damage...) must be indicated on the carrier's delivery slip in the form of "handwritten reservations" describing the anomaly in a clear and detailed manner.

            The Customer shall at the same time report this anomaly to Apoticaria within two (2) working days after the delivery date, either by contacting Apoticaria's customer service by phone at: +33 (0)5 62 66 50 76 or by e-mail at: contact@apoticaria.com describing the anomaly encountered.

            Any product to be exchanged or refunded must be returned to Apoticaria at the Customer's expense in its original packaging, by registered mail, to the following address

            Any claim not made in the rules defined above and within the time limits set will not be taken into account and will release Apoticaria from any responsibility towards the Customer.

            Article 9 - Legal guarantees

            All products on sale on the Site benefit from the legal guarantee of conformity (as defined in articles L217-4 and following of the French Consumer Code) and the guarantee against hidden defects (as defined in articles 1641 and following of the French Civil Code), allowing the consumer to return defective or non-conforming products at no cost.

            9.1 - Legal warranty of conformity

            The French Consumer Code provides for the following in terms of the legal guarantee of conformity:

            • Article L217-4: The seller is obliged to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.
            • Article L211-5: To be in conformity with the contract, the goods must :

            1) Be fit for the purpose ordinarily expected of similar property and, where applicable:

            • correspond to the description given by the seller and have the qualities that he presented to the buyer in the form of a sample or model;
            • have the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;

            2) Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. 

            - Article L211-12: The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good. 

            9.2 - Warranty against hidden defects

            • Article 1641 of the Civil Code: The seller is bound by the warranty for latent defects of the thing sold which render it unfit for the purpose for which it was intended, or which so diminish that purpose that the buyer would not have acquired it, or would have given only a lesser price, if he had known of them.
            • Article 1648 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

            9.3 - Terms of implementation of legal guarantees

            When he acts in legal guarantee of conformity, the consumer :

            - has a period of two years from the delivery of the property to act;

            -may choose between repair or replacement of the goods unless either choice would result in a manifestly disproportionate cost to Apoticaria.

            - is exempted from proving the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods;

            The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

            The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code; In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

            These provisions are not exclusive of the right of withdrawal defined in Article 10 below.

            9.4 - Consequence of the implementation of the guarantees

            Within the framework of the legal guarantee of conformity, Apoticaria is committed to the consumer's choice:

            • or to replace the product with an identical product depending on available stocks,
            • or to refund the price of the product if the replacement of a product was impossible.

            Within the framework of the legal guarantee of hidden defects, Apoticaria, according to the choice of the consumer, undertakes, after evaluation of the defect :

            • or to refund the full price of the returned product,
            • or to refund a part of the price of the product if the buyer decides to keep the product.

            Article 10 - Right and time of withdrawal

            10.1 Right of withdrawal

            In accordance with the provisions of Article L 121-21 of the Consumer Code, you have the right to withdraw from this contract without giving any reason, within fourteen days of receiving your Order.

            In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for orders concerning :

            • the supply of goods which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection,
            • the supply of goods made to the consumer's specifications or clearly personalized.

            These provisions apply without prejudice to the guarantees provided for in Article 9 "Legal Guarantees" of these GTC, which remain fully applicable.

            10.2 Exercise of the right of withdrawal and return procedure

            To exercise your right of withdrawal, in accordance with the provisions of Article L121-21-2, you must notify us of your decision to withdraw by means of a written statement unambiguous, by e-mail to the following address: contact@apoticaria.com ) or by mail (see address in Article 1 above). You can, if you wish, use the model of retraction below:

            In order for the withdrawal period to be observed, it is sufficient for you to send us your written request to exercise the right of withdrawal before the expiration of the withdrawal period.

            In case of a timely withdrawal, if the products have not yet been shipped to you, we will refund the amount of the Order within 14 days from the day we are informed of your decision to withdraw.

            In case of withdrawal from your part within the time limits, in case you have received the products, it will be enough for you to refuse the goods when they are delivered to you.

            In the event that you have already received the products, you must return the ordered products, by Colissimo Recommandé, to the following address: Apoticaria, Service Retour, BP 9, 32190 Vic-Fézensac at the latest 14 days after you have informed Apoticaria of your decision to withdraw.

            Only products returned in their original packaging, complete and intact, and in perfect condition for resale will be accepted.

            Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.

            In the event of the exercise of the right of withdrawal, the consumer has the choice of requesting either a refund of the sums paid, or a refund in the form of a credit note, or an exchange of products.

            If the right of withdrawal is exercised in the form of a refund request, Apoticaria will refund the amounts paid by the consumer within 14 days from the day the Buyer's decision to withdraw was brought to the attention of Apoticaria. The consumer will then be reimbursed by re-crediting his/her bank account (secure transaction) in case of payment by credit card, or by check in other cases. Any Order paid by the Bitpay application will not be refundable in the crypto currency used for payment, but in Euros by bank transfer.

            In the case of a product exchange request, you will be reimbursed for the standard shipping costs of the initial product order (first delivery) and you will be charged for the shipping costs of the exchanged products (second delivery) depending on the delivery method chosen.

            Article 11 - Responsibilities

            11.1 Apoticaria shall not be liable for the obligations under these General Terms and Conditions of Sale in the event that the non-performance of its obligations is attributable to the act of a third party even if foreseeable, to the actions of the Buyer, or to the occurrence of an event of force majeure as defined in article 11.6 hereinafter, or to any other event which was not reasonably under the exclusive control of Apoticaria;

            11.2 In the event that Apoticaria's liability is firmly and finally established as a result of a loss suffered by Buyer and attributable exclusively to the placing of an Order, the total amount of compensation shall not, by express agreement, exceed twice the amount of the Order placed and paid by Customer to Apoticaria.

            11.3 The products offered on the Site comply with current French legislation. Apoticaria declines all responsibility in the event that the product delivered does not comply with the legislation of the country of delivery.

            11.4 The products must only be used for the purposes and quantities stipulated on the packaging or, failing that, for those envisaged in the precautions and indications of use appearing in the product description sheet posted on the Site, in particular the "Sanchlor", "Sanchlor Kit", "Sodium Chlorite + Hydrochloric Acid Kit", "DMSO" and fertilizer products. In case of contrary use or misuse, no warranty will be owed by Apoticaria. Apoticaria will not be held responsible for any damage or accidents caused by the products distributed.

            11.5 Information and warnings concerning the use of the products: "Sanchlor", "Sanchlor Kit", "Sodium Chlorite + Hydrochloric Acid Kit", "DMSO" and fertilizer products

            Information and warnings on the precautions for use of "Sanchlor" and "Sanchlor Kit", "Sodium Chlorite + Hydrochloric Acid Kit", "DMSO" and fertilizer products sold on the Site are posted on the Site. The Customer is invited to consult the detailed information concerning these products, in particular their contra-indications and contra-uses, on the website of the Poison Control Centre: in this respect, the Customer is informed in particular that he/she can consult and download the risk assessment report issued by the Toxicovigilance Coordination Committee concerning this family of products and available by clicking on the following link: http: //www.centres-antipoison.net/CCTV/Rapport_CCTV_Solution_minerale_miracle_2010.pdf

            If swallowed, call the Poison Control Centre immediately or see your doctor.

            Consequently, Apoticaria shall not be held responsible for any damage that may result directly or indirectly from the use of " Sanchlor" and/or "Sanchlor Kit", "Sodium Chlorite + Hydrochloric Acid Kit", "DMSO" or fertilizer products sold on the Site, in particular in the event of inhalation, contact with the skin, hair or eyes, or ingestion, or taking them orally or internally; the latter being likely to cause, in particular, without this list being exhaustive, intoxications, burns, irritations, undesirable effects and/or side effects, or any other medical disorders, or even death.

            11.6 Force majeure

            Apoticaria shall not be liable for the total or partial non-performance of its obligations under these GTCs or any Order or Pre-order, if such non-performance is caused by an event constituting force majeure recognized as such by the jurisprudence, including natural events, bad weather, work stoppages of Apoticaria's or its suppliers' personnel, fires, floods, regulatory, administrative or judicial injunctions, imminent dangers the prevention of which is not the direct responsibility of Apoticaria, interruptions in transport services, failure or breakdown of equipment, means of transport, communication, or any circumstance that cannot be controlled by Apoticaria that prevents Apoticaria in whole or in part from performing its obligations under normal conditions.

            The Parties agree that they shall consult as soon as possible in order to determine together the terms and conditions for the performance of these GTC or of any Order or Pre-order during the period of force majeure.

            Article 12 - Intellectual Property

            Apoticaria's trademark, company name, logo, domain name and the content of the Site are protected by French and international intellectual property laws. They are and remain the property of the Seller.

            Any reproduction, representation, adaptation or translation, in any form whatsoever, of all or part of the Site or of the elements of the Site without the prior written consent of the Vendor is strictly forbidden and engages the responsibility of its author. No commercial use, even partial, of the data presented on the Site may be made without the prior written consent of the Vendor.

            Article 13 - Data processing and liberties

            All personal information you provide to us while using the Site, including but not limited to personal information collected during any registration or ordering process, is subject to the Site's Privacy Policy, which is an integral part of these Terms and Conditions of Sale and is accessible on the Apoticaria website: www.apoticaria.com, from a link provided at the bottom of each page of the Site (the " Privacy Policy ").

            The information and data requested from you are necessary for the processing of your Order, delivery and invoicing, and may be communicated to Apoticaria's contractual partners involved in its execution.

            You have the right to access, rectify and object to the personal data concerning you, which you can exercise by sending an e-mail to the following address: contact@apoticaria.com, or to the following postal address APOTICARIA SARL, Lieu dit Mateuil, 32190 Belmont, under the conditions provided for by the law of 6 January 1978.

            Article 14 - Validity of the General Conditions

            If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions shall remain unchanged and shall remain applicable.

            Article 15 - Non-waiver

            The fact that Apoticaria refrains from demanding at a given time the execution of any of the provisions of these General Terms and Conditions of Sale cannot be interpreted as a waiver of the right to invoke said total or partial non-execution at a later date.

            Article 16 - Mediation

            In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale or the performance of the Order, the Customer may have recourse to conventional mediation, in particular with the Commission de la Médiation de la Consommation (Consumer Mediation Commission) or with existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example). In accordance with the ordinance n°2015-1033 of August 20, 2015 and the application decree n°2015-1382 of October 30, 2015, any dispute or litigation known as consumer, subject to article L612-2 of the Consumer Code, can be the subject of an amicable settlement by mediation.

            Before doing so, the Customer must send a request to Apoticaria by registered mail with return receipt to try to find an amicable solution.

            In the absence of an amicable agreement with Apoticaria's customer service, the Customer may submit the dispute to the consumer mediator CMAP (Centre de médiation et d'arbitrage de Paris) accessible at the URL address: http: //www.cmap.fr or at the postal address: CMAP (Service Médiation de la Consommation) - 39 avenue Franklin D. Roosevelt - 75008 Paris or to the European Commission via its online dispute resolution platform available on the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage in accordance with Directive 2013/11 of the European Parliament and of the Council of 21 May 2013 on the out-of-court settlement of consumer disputes and Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the online settlement of consumer disputes.

            Regardless of the method used to submit the dispute to the mediator, the Customer's request must contain the following information: the Customer's postal address, e-mail address and telephone number, a brief summary of the facts and evidence of any steps already taken with Seller's customer service department.

            Article 17 - Applicable law - Competent jurisdiction

            These GTC and any order placed on the Site are subject to French law, regardless of the country of residence of the Buyer and the place where the Order is placed.

            In the absence of an amicable agreement between the parties, any dispute relating to the existence, interpretation, performance or breach of contract between Apoticaria and the Buyer, even in the event of multiple defendants, shall be subject to the exclusive jurisdiction of the French courts pursuant to the rules set forth in the French Code of Civil Procedure.

            When the Customer acts as a professional, jurisdiction is expressly attributed to the commercial court of the place of Apoticaria's registered office, notwithstanding multiple defendants and/or warranty claims, even for emergency proceedings or protective proceedings in summary proceedings or by petition.
